If you believe that any user-generated content appearing in a Sony Pictures Entertainment (“SPE”) controlled website or app (collectively “Site”) violates your copyrighted work or that your submitted content has been wrongfully removed from the Site, you may contact SPE for an infringement claim or counter-claim, respectively, in accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”).
In compliance with the DMCA your notification or counter notification, to be effective, must be in writing, sent to SPE's Designated Copyright Agent as specified below, and include the following information:
- your physical or electronic signature of the person authorized to act on behalf of the copyright owner;
- identification of the material that has been infringed and the location where the material appears or, in the case of a counter notification, identification of the material that has been removed or to which access has been disabled and the location where the material previously appeared;
- a statement under penalty of perjury that the use of the material is not authorized by the copyright owner, its agent, or at law or, in the case of a counter notification, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled; and
- your name, address, and telephone number and a statement that you consent to the jurisdiction of the Federal District Court in the district in which your address is located (or in the Central District of California, for addresses outside the USA) and, in the case of a counter notification, you agree to accept service of process from the person who submitted the original infringement notification that resulted in the materials being removed (or an agent of such person) in the event he or she elects to file suit.
By submitting an infringement notification or a counter notification, you acknowledge and agree that SPE may forward your notification and any related communications to the person who posted the material identified or submitted the original infringement notification that resulted in the removal of your user-generated content or to other third parties.
